In The fight against LGBTQ boys, school officials are Reviving An Old Weapon

Because of dress code policies, which advocates claim disproportionately affect LGBTQ+ kids and women, schools across the country have denied students access to graduation, graduation ceremonies, and other university events.
Sophie Savidge, a 16-year-old Florida junior, received a warning in May that she couldn’t attend prom because she wore a suit. Additionally, Harrison County School District sued the American Civil Liberties Union of Mississippi for preventing a transgender woman from attending her local band music this spring. The district’s two-year pattern of punishing women for breaking dress codes that require students to wear clothing that is “consistent with their natural sex” was detailed in the problem.

The school district added the provision of “biological sex” to its dress code after LGBTQ+ students complained that they couldn’t wear clothes that expressed their gender identity, said Liz Davis, a fellow at the ACLU’s Women’s Rights Project.

Dress codes have been around for a long time and have always been followed by school officials. As a record number of anti-LGBT costs have been introduced in statehouses across the country, there has been a renewed effort this year to enact policies that are more directly stringent to queer, transgender, and gender nonconforming learners.

According to Davis, “requiring students to gown according to their biological sex, even if it seems to be balanced as a rule, and it’s not calling out any special student,” has a significant impact on gender nonbinary, intersex, and transgender students because it ties gender expression to their sex assignment at birth, essentially,” even though it seems to be balanced as a rule.

Some state-level laws now include sex definitions that explicitly forbid trans people from updating their drivers licenses or state IDs, making it more difficult to travel and exist in public spaces.

Advocates claim that putting a focus on “biological sex” has harmful effects on all people, including cisgender women, because it encourages people to monitor one another’s gender, including children. People have harassed transgender people who they believe are transgender, and a state official in Utah has been accused of fabricating a transgender identity based on her appearance.
Previously, sex and gender researchers have discovered that binary definitions of sex do not accurately represent how scientists currently define human sex, which is influenced by a range of biological phenomena, including hormones, genitals, and otter secondary sex characteristics.

As more and more anti-LGBT legislation clarifies how LGBTQ+ students can and cannot express themselves and participate in academic activities, Davis said she would not be surprised if more schools across the nation adopted policies that explicitly state “biological sex provisions.”

According to Davis, those kinds of provisions are likely to violate Title IX, a 1972 federal law that prevents discrimination based on sexual orientation in public schools and colleges.

The Biden administration expanded the definition of sex discrimination to include gender identity and sexual orientation in its long-awaited spring release. More than a dozen red states have since acted in response to this updated interpretation.
